1. Agreement to These Terms
These Terms are a binding agreement between you and LemonMarket. By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service. Please read section 18 (Limitation of Liability) and section 20 (Dispute Resolution) carefully. Section 20 requires most disputes to be resolved by individual arbitration, and waives your right to a jury trial and to take part in a class action — unless you opt out, which you may do within 30 days.
2. What LemonMarket Is
LemonMarket is a marketplace that connects parents and caregivers who want to buy, sell, and review pre-loved baby and pregnancy gear. You can post listings, post Wanted requests, browse a community product catalog, review products, subscribe to alerts, and message other users. LemonMarket is a platform, not a shop. We do not own, inspect, store, or ship any item listed here.
3. Eligibility
You must be at least 18 years old to use LemonMarket. By creating an account, you confirm that you are. You must give accurate information, keep it current, and keep your credentials secure. You are responsible for everything that happens under your account.
4. Fees
LemonMarket is currently free. We charge no listing fee, no selling fee, and no commission, and we do not process payments. If we ever introduce fees, we will tell you before they apply to you.
5. Transactions Are Between Users
We are not a party to any transaction. We do not process payments, hold funds, verify items, arrange delivery, or mediate disputes. Buyers and sellers agree payment and pickup directly with each other, and every transaction is at your own risk. For your own safety: • Meet in a safe, public place. • Inspect an item thoroughly, in person, before you pay. • Be wary of anyone pressuring you to move the conversation or the payment off-platform. • Report anything suspicious.
6. Listing Requirements
Every listing must: • describe the item and its condition accurately and honestly • use recent photos of the actual item you are selling — not stock images • state a clear price and clear pickup terms • be a baby, kid, or pregnancy related item • comply with all applicable laws and safety standards Do not post false, misleading, or duplicate listings, and do not list items you do not have.
7. Prohibited Items
Some second-hand baby gear is genuinely dangerous, and some of it is illegal to resell. You may not list: • Any product subject to a safety recall. Check before you list — recalls are published at cpsc.gov/Recalls. • Drop-side cribs, and any crib that does not meet current federal safety standards. These are banned from resale. • Inclined sleepers, and any product banned under the Safe Sleep for Babies Act. • Car seats that are expired, have been in a crash, are of unknown history, or are missing their label, manual, or original parts. • Infant formula, baby food, or any consumable that is expired, opened, recalled, or improperly stored. • Any item with missing, broken, or substituted safety components — straps, buckles, harnesses, anchors, latches. • Used breast pump parts that come into contact with milk, and any single-user medical device. • Counterfeit goods, stolen property, illegal substances, weapons, or anything else prohibited by law. We may remove any listing we believe falls into these categories, and we may suspend accounts that repeatedly post them.
8. Product Safety
You are responsible for what you sell, and for what you buy. If you sell, you must check for recalls before listing, and you must disclose any known safety issue, missing part, modification, damage, or expiration date. If you buy, you are responsible for assessing an item's condition, safety, recall status, and suitability for your child before you use it. Age ranges, stage recommendations, and catalog information in the app are convenience features, generated automatically. They are not safety advice and not an endorsement. We do not inspect items. We cannot and do not verify that any item is safe.
9. User Conduct
You may not: • post false, misleading, or deceptive content • engage in fraud, scams, or illegal transactions • harass, threaten, abuse, stalk, or impersonate anyone • post content that is unlawful, hateful, discriminatory, sexually explicit, or that endangers a child • spam, advertise, or use the Service to solicit off-platform • scrape the Service, upload malicious code, or attempt to breach or overload it • create multiple accounts to evade a restriction or a ban
10. Wanted Requests, Matching and Messaging
Wanted requests are public, and are subject to the same rules as listings. Matches are automated suggestions based on category and keyword. They are not endorsements, and they do not guarantee that anything will come of them. In messages, treat people the way you would want to be treated. Do not harass, scam, or spam. We may read message content when investigating a report.
11. Reviews
Reviews must be based on your genuine experience with the product. Do not post reviews that are dishonest, incentivized, offensive, or that reveal someone else's private information. If you delete your account, your reviews stay but are anonymized — see the Privacy Policy, section 10.
12. Your Content
You keep ownership of everything you post. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute your content for the purpose of operating and promoting the Service, and to make the technical changes needed to do that (resizing a photo, for example). This licence ends when you delete the content — except for copies already made in the ordinary course, such as backups, and content we must keep under section 9 of the Privacy Policy. You confirm that you have the right to post everything you post. The LemonMarket name, design, and software are ours. Do not copy, modify, or reverse engineer them.
13. Copyright and Takedown
If you believe content on LemonMarket infringes your copyright, send a notice to yingjiehe@zestworks.io including: • your contact details • identification of the work you say is infringed • the specific listing or content, with enough detail for us to find it • a statement that you believe in good faith that the use is not authorized • a statement, under penalty of perjury, that your information is accurate and that you are the rights holder or authorized to act for them • your physical or electronic signature We will remove infringing content and, where appropriate, terminate repeat infringers.
14. Objectionable Content and Abusive Users
We have zero tolerance for objectionable content and abusive behaviour. You can report any listing and any user profile from inside the app. You can also block any user — blocking immediately hides that person's listings and messages from you. When we receive a report we aim to review it within 24 hours, and we remove content and remove users that violate these Terms. A listing reported by three or more different users is hidden automatically and immediately, before we have reviewed it, and stays hidden until we do. We may suspend or permanently terminate an account for a single violation, without notice, at our discretion. If your account is banned, you may not create another one.
15. Listing Lifecycle
A listing is hidden from the public feed 45 days after it is posted, and permanently deleted — along with its photos and video — 60 days after it is posted. We warn you before that happens, and you can renew a listing to reset the clock. Keep your own copy of any photo you care about. We are not a backup service.
16. Termination
You may stop using LemonMarket at any time, and you can delete your account from Settings. Deletion is permanent — see the Privacy Policy, section 10, for what it removes and what it keeps. We may suspend or terminate your account if you breach these Terms, if the law requires it, or if we discontinue the Service. Sections 12, 17, 18, 19, 20 and 22 survive the end of this agreement.
17. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that any listing or user information is accurate; that any item is safe, legal, genuine, or as described; that any transaction will complete; or that the Service will be uninterrupted or error-free. You are solely responsible for your dealings with other users.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, or goodwill. We are not liable for the conduct of any user, for any item bought or sold, or for any content posted on the Service. Our total liability to you, for any and all claims, will not exceed one hundred US dollars ($100). Some jurisdictions do not allow some of these exclusions, so parts of this section may not apply to you. Nothing here limits any liability that cannot be limited by law.
19. Indemnification
You agree to indemnify and hold harmless LemonMarket and its operators against any claim, loss, liability or expense (including reasonable legal fees) arising out of your use of the Service, your content, any item you buy or sell, your breach of these Terms, or your violation of any law or of anyone else's rights.
20. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights. Talk to us first. Before starting formal proceedings, email yingjiehe@zestworks.io describing the dispute. We will try in good faith to resolve it with you within 60 days. Arbitration. If we cannot, you and we agree that any dispute will be resolved by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitrator's decision is final. Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may seek an injunction to protect intellectual property. Class action waiver. Disputes must be brought individually. You and we both waive any right to take part in a class, collective, or representative action, and an arbitrator may not consolidate claims. Your right to opt out. You may opt out of arbitration and of the class action waiver by emailing yingjiehe@zestworks.io within 30 days of first accepting these Terms, giving your name and the email address on your account. Opting out affects nothing else, and we will not hold it against you. Governing law. These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules.
21. Changes to These Terms
We may update these Terms. If a change is material, we will update the date at the top and tell you in the app before it takes effect. Continuing to use LemonMarket after that means you accept the new Terms. If you do not accept them, stop using the Service and delete your account.
22. General
Language. These Terms and the Privacy Policy are made available in English, and the English version is the only authoritative one. If we ever publish a translation, it is provided for convenience only, and the English version governs in the event of any difference. If any part of these Terms is found unenforceable, the rest stays in force. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these Terms. We may transfer ours — for example, if the Service is acquired. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
