1. Agreement to Terms
By accessing or using LemonMarket ("the App," "our Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.
2. Service Description
LemonMarket is a marketplace platform that connects parents and caregivers to buy, sell, and review baby and maternity products. The platform includes features for: • Posting and browsing second-hand baby items • Product reviews and recommendations • Category subscriptions and notifications • In-app messaging between users • Price history tracking
3. User Accounts
You must be at least 18 years old to use this Service. You must provide accurate, complete, and current information. You are responsible for maintaining the security of your account and for all activities that occur under your account.
4. User Conduct - Prohibited Activities
You may NOT: • Post false, misleading, or deceptive listings • Engage in fraud, scams, or illegal transactions • Sell counterfeit, stolen, or prohibited items • Harass, threaten, or abuse other users • Violate any applicable laws or regulations • Upload malicious code or attempt to compromise the platform • Create multiple accounts to circumvent restrictions
5. Listings Requirements
All listings must: • Accurately describe the item's condition • Include honest, recent photos of the actual item • State clear pricing and pickup/delivery terms • Comply with all applicable laws and regulations • Only include baby and maternity-related items
6. Prohibited Items
You may NOT list: • Recalled or unsafe products • Expired items (formula, car seats past expiration) • Items with missing safety components • Counterfeit goods • Stolen property • Illegal substances or materials
7. Transactions
LemonMarket is a marketplace platform only. We do NOT process payments or handle physical transactions. We are NOT party to any transactions between users. Users arrange all payment and delivery terms directly. Users should meet in safe, public locations, inspect items before payment, use secure payment methods, and report suspicious activity immediately.
8. Content and Intellectual Property
You retain ownership of content you post. By posting, you grant LemonMarket a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content. You represent that you have rights to post all content. LemonMarket owns all platform intellectual property. You may not copy, modify, or reverse engineer our platform.
9. Reviews and Ratings
Reviews must be based on genuine experience with the product, be honest and not misleading, not contain offensive or inappropriate content, and not violate anyone's privacy or rights.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee accuracy of listings or user information, quality, safety, or legality of items, successful transactions, or continuous, uninterrupted service. You are solely responsible for verifying item condition and safety, conducting safe transactions, ensuring legal compliance, and your interactions with other users.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: • LemonMarket is NOT liable for any indirect, incidental, consequential, or punitive damages • Our total liability shall not exceed $100 or the amount you paid us in the past 12 months • We are NOT liable for user conduct, transactions, or content
12. Product Safety
Users must disclose: • Known safety issues or recalls • Missing parts or components • Expiration dates (for car seats, formula, etc.) • Any modifications to original items Users must check for product recalls before listing. We may remove listings for recalled items.
13. Dispute Resolution
These Terms are governed by the laws of the State of Washington, United States. Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules. You agree to resolve disputes individually, not as part of a class action or representative proceeding.
14. Wanted Requests
You may post "Wanted" requests for items you are looking to buy. Requests are public and must follow the same rules as listings: • Be genuine and accurate • Relate to permitted baby, kid, or pregnancy items • Must not be used for spam, solicitation, advertising, or to seek prohibited items We may remove requests that violate these Terms.
15. Matchmaking & Messaging
LemonMarket may surface matches between listings and Wanted requests and let you contact other users through in-app chat. • Matches are automated suggestions based on category and keywords; they are not endorsements, and we do not guarantee a transaction will result • You are responsible for your conduct in messages: no harassment, scams, spam, or attempts to move payment off-platform to defraud another user • We are not a party to any transaction and do not mediate disputes between users
16. Personalized Recommendations
If you provide baby age or due-date information, we use it to show age-appropriate recommendations. Recommendations are provided for convenience only, are generated automatically, and are not endorsements or safety guarantees. You remain responsible for assessing any item's suitability, condition, and safety (including recalls and age ratings) before purchase. Providing baby information is optional and can be removed at any time.
